Eviction
An unlawful detainer action is required to evict an occupant. Eviction actions are regulated by Minnesota Statutes Chapter 504B.

The property owner (plaintiff) must file an eviction action complaint in housing court. The court will establish a court hearing date and issue a summons. The summons and complaint must be served by a neutral person at least 7 days before the court date.
To have us serve the eviction summons and complaint, bring the original documents and a copy for each person named in the complaint. The sheriff’s office will not make copies for you. You must pay the $80 fee when you request this service.
After service, or posting if unable to serve after 2 attempts, the sheriff’s office will:
- Complete the appropriate affidavits
- E-file the documents with the court
Writ of recovery
If the court finds for the plaintiff, it will issue a writ of recovery of premises and order to vacate.
Bring that writ to the sheriff’s office and pay the $125 service fee. A deputy will serve or post the writ. The writ notifies the occupant(s) to vacate and remove their property within 24 hours.
Schedule a lockout
You may only schedule a lockout 24 hours after the writ of recovery has been posted. If you aren’t sure if the writ has been posted yet, or if you have any other questions, please call the civil office at 612-348-3801.

- You will receive an email confirmation once the civil office has approved your appointment request.
If I schedule a lockout for 9:45 a.m., will the deputies be there right at 9:45 a.m.?
No. All lockouts are scheduled in a 2-hour service window. The specific times are only used to show how many slots are available each day. All morning appointments, regardless of the exact time scheduled, will occur between 9 – 11 a.m., and all afternoon appointments will occur between 1 – 3 p.m.
Will I receive an email confirmation?
Yes, you will receive an email confirming your appointment, as well as a reminder email one day in advance.
How do I cancel or reschedule a lockout?
The confirmation email you received includes a link to cancel or reschedule the lockout.
How do I schedule multiple lockouts at the same property address?
Please submit a separate appointment request for each lockout, even if they’re at the same address. Just be sure to keep the appointments all on the same day, and all within either the morning or afternoon.
How do I change the information I submitted in the form?
Please call the civil office at 612-348-3801 to update any information you submitted when scheduling, including to update the contact person’s information.
